Charter agreements for voyages in Indonesian waters adhere to Indonesian civil and commercial law, which dictates interpretation, enforcement, and dispute resolution. The contract you receive is in English, though its legal efficacy derives from the Indonesian version, which may be referenced in case of ambiguity. Reputable companies use legal counsel to keep contracts fair, comprehensive, and compliant.
Should a dispute arise, the contract specifies the forum — typically arbitration in Indonesia (often Jakarta) or the Indonesian court system. These provisions are standard; understanding the legal basis from the outset assures clients that their interests are protected under a recognised system.
What to Read Closely
Defines start/end dates, times, and locations. Captains retain discretion to adjust the route for weather, sea state, or guest safety — always made in your interest and discussed transparently.
A deposit secures your booking, with staged payments leading to departure. The Advance Provisioning Allowance (APA) covers variable on-board expenses.
A forfeiture schedule based on proximity to the charter date. Force Majeure protects both parties from events beyond reasonable control — alternative dates or credit notes are typically offered.
The vessel carries hull, machinery, and third-party liability cover. Guests must arrange comprehensive personal travel and medical insurance for cancellation, evacuation, and belongings.
